Selling a Probate or Trust Property in the Portland Area
Personal representatives and trustees carry the legal duty; we carry the logistics. Clean-out, repairs, pricing, title, and closing, coordinated with your probate attorney by a principal broker who is also a licensed Oregon attorney.
Who We Help
-
Personal representatives selling a house through an Oregon probate.
-
Successor trustees selling a house held in a living trust.
-
Heirs who have inherited a house together and need to sell or divide it.
-
Out-of-state personal representatives who need someone local to manage the property.
-
Probate and estate planning attorneys who need a broker they can rely on.
How We Handle a Probate or Trust Sale

Authority First. We confirm who can sign, using the letters or the trust documents, before the house goes on the market.

Protect the Property. We check on vacant houses, coordinate locks and insurance requirements, and report to you in writing.

Clean-out and Preparation. We manage clean-out, estate sale, repair, and staging vendors, and help you decide whether preparation pays or an as-is sale makes more sense.

Honest Pricing. We price the listing from current market data and refer you to a licensed appraiser when the estate needs a date-of-death value.

Early Title Review. We order a preliminary title report up front, so liens, old deeds, and title defects are fixed before a buyer is under contract.

Direct Work with Your Attorney. We coordinate with the estate's probate attorney and follow any court order to the letter.

Clean Closing. Escrow pays off the loans and liens and sends the net proceeds to the estate or trust account.

How It Works
-
Confidential consultation. We learn whether the house is in probate or a trust, who has authority, and what the estate needs.
-
Plan and preparation. We secure the house, manage clean-out and repairs, and review title.
-
List and market. We price from current data and market the house to qualified buyers.
-
Offers. The personal representative or trustee reviews and signs every offer, with written recommendations from us.
-
Closing. Escrow pays off loans and liens and delivers the net proceeds to the estate or trust.
Service area: Portland, West Linn, Lake Oswego, Wilsonville, Tualatin, Oregon City, Canby, and the surrounding Portland metro area.
Frequently Asked Questions
Can a personal representative sell a house without court approval in Oregon?
Usually yes. Once the court issues letters, a personal representative can sell estate real property without a court order unless the will restricts the sale or leaves the house to a specific person.

Can you help if the house is in a trust instead of probate?
Yes. The successor trustee sells the house under the trust, usually without any court case, and we handle the sale the same way.

I live out of state. Can you manage the sale for me?
Yes. We manage clean-out, repairs, showings, and vacant-property checks locally and report to you in writing. Documents can be signed electronically or with a mobile notary.
Do you provide legal advice on the probate?
No. Howell Real Estate Partners is a real estate brokerage, not a law firm. We work alongside the estate's probate attorney.
