Selling a Home During a Divorce in the Portland Area
One neutral listing. Clear written rules both spouses sign. A principal broker who is also a licensed Oregon attorney and litigator, so court orders, attorneys, and escrow holds are handled correctly the first time.
Who We Help
-
Divorcing spouses who agree to sell and want the sale handled fairly.
-
Spouses in a contested case who need a broker the court and both attorneys can trust.
-
Family law attorneys and mediators who need a neutral listing broker or a court-ordered sale handled to the letter of the order.
-
Ex-spouses who still co-own a home after the judgment.

How We Handle a Divorce Sale
One neutral listing. Both spouses sign one listing agreement. Every update goes to both of you, in writing, at the same time.

Authority first. We confirm title and any court orders before the house goes on the market, so the sale complies with Oregon's automatic divorce restraining order.
Rules in writing. Before we list, both spouses sign a plan for the price, scheduled price reductions, showings, repairs, and which offers to accept.
Direct work with attorneys. We coordinate with both family law attorneys and follow stipulated orders and judgments exactly.
Protected proceeds. We arrange with escrow to hold the net proceeds until the judgment or joint written instructions.
Honest valuation. We price the listing and refer case valuations to licensed appraisers when the attorneys or the court need one.
Why Howell Real Estate Partners
Tyler Howell is the principal broker of Howell Real Estate Partners and a licensed Oregon attorney. He has spent more than a decade as a civil litigator in real estate disputes. He served as Director of Commercial Operations for a National Title Company in Portland. How It Works
-
Confidential consultation. We learn where the case stands and who is on title.
-
Authority and plan. Both spouses sign the listing and the written plan, or the court orders the sale.
-
Prepare and list. Repairs, staging, and showings run under the agreed rules.
-
Offers. Offers within the pre-agreed terms go to both spouses for signature.
-
Closing. Escrow pays off the loans and holds the net proceeds as the judgment or both spouses direct.
Service area: Portland, West Linn, Lake Oswego, Wilsonville, Tualatin, Oregon City, Canby, and the surrounding Portland metro area.
Frequently Asked Questions
Can I sell my house during a divorce in Oregon?
Yes. Once the case is filed and served, you need your spouse's written consent or a court order, even if the house is titled in one name.
Should we use the same broker?
Usually yes, when you both sell to an outside buyer. If one spouse buys out the other, separate brokers are usually safer.
Do you work with our attorneys?
Yes. With your permission, we copy both attorneys and follow any stipulated order or judgment.
Can you value the house for our divorce case?
We price homes for sale. When the attorneys or the court need a value for dividing property, we refer you to a licensed appraiser.
